Crypto-assets and MiCA

Crypto-asset service provider (CASP) authorisation under MiCA and ongoing compliance.

Regulation (EU) 2023/1114 (MiCA) requires crypto-asset service providers to hold an authorisation from the competent authority, in Slovenia the ATVP. The office advises on the application, internal policies and documents, crypto-asset white papers and providing services in other EU member states.

The authorisation procedure

The ATVP must acknowledge receipt of the application within five working days and assess within 25 working days whether it is complete. It decides on a complete application within 40 working days. If it requests further information, the period can be suspended for up to 20 working days (Article 63 MiCA).

Duties after authorisation

A provider must meet requirements on capital, governance, safekeeping of client assets, complaints handling and anti-money laundering. The authorisation is valid across the EU; services in other member states start after notification through the ATVP.

Typical matters

  • CASP authorisation application to the ATVP
