How do I arrange a consultation?
You can arrange a consultation by email or phone. Please describe the matter briefly so that we can prepare for the meeting. Consultations take place at the office at Dunajska cesta 5, Ljubljana, or by video call.
How are fees charged?
Fees are usually charged on a time basis, at an hourly rate agreed with the client in writing. Invoices are issued monthly with a specification of the services: dates, descriptions and hours spent.
Do you advise foreign clients?
Yes. Advice is given in Slovenian or English, and the relationship with a foreign client is set out in an engagement letter. Invoices and specifications can be issued in English.
Does the office represent clients in court?
Yes. The office represents clients in court. It also advises clients and represents them in procedures before supervisory and administrative authorities, mainly the Slovenian Securities Market Agency (ATVP).
How long does an ATVP authorisation take?
It depends on the type of authorisation and how complete the application is. For a crypto-asset service provider authorisation under MiCA, the ATVP assesses completeness within 25 working days and decides on a complete application within 40 working days. It decides on approval of a qualifying holding within 60 working days under ZTFI-1. Requests for more information extend these periods, so a carefully prepared application is the fastest route.
Which documents does an authorisation application need?
Usually a business plan, a description of the organisation and internal controls, proof of capital, details of qualifying shareholders and documents on the management and supervisory board members. The exact list depends on the type of authorisation and is prepared for your matter at the first consultation.
Is my matter confidential?
Yes. Under the Slovenian Attorneys Act a lawyer must keep confidential everything a client has entrusted to them. The duty also binds the office's staff and continues after the engagement ends.
Why do you need details about me and the beneficial owner?
Under the Slovenian Prevention of Money Laundering and Terrorist Financing Act (ZPPDFT-2) a lawyer is an obliged entity for certain services. For these, the lawyer must identify and verify the client and its beneficial owner and the purpose of the business relationship. The data is used only for that purpose.
